US Supreme Court Denies Epic’s Request to Enforce App Store Order

The US Supreme Court has rejected the request made by Epic Games to enforce an order against Apple in the ongoing legal battle between the two companies. Epic Games, the creator of the popular game Fortnite, sought to have a lower court’s ruling take immediate effect. However, the highest court in the United States denied their bid.

This decision comes as a setback for Epic Games in their attempt to challenge Apple’s App Store policies. The legal dispute between the two tech giants began in August 2020 when Epic Games introduced a direct payment system within Fortnite that bypassed the App Store’s standard 30% commission fee. In response, Apple swiftly removed Fortnite from its platform, leading to a series of lawsuits and counterclaims.

Epic Games argued that Apple’s control over the App Store amounted to anticompetitive behavior, stifling competition and innovation. They sought relief through a preliminary injunction that would have required Apple to reinstate Fortnite on the App Store while the case was being litigated. However, the district court ruled in favor of Apple, stating that Epic Games had violated its contractual agreement with Apple by implementing the alternative payment system.

Following the district court’s decision, Epic Games appealed to the Ninth Circuit Court of Appeals, but the appellate court largely upheld the lower court’s ruling. While it did recognize some anticompetitive aspects of Apple’s conduct, the appeals court also concluded that Apple’s actions were within the bounds of its contractual rights.

In their recent bid to the US Supreme Court, Epic Games sought to bypass the lengthy legal process and have the lower court’s order immediately enforced. They argued that the urgency of the situation called for swift action, emphasizing the significance of the case’s impact on the broader app ecosystem.

However, the Supreme Court’s denial of Epic Games’ request indicates that it does not view the situation as requiring immediate intervention. This decision maintains the status quo, with Fortnite remaining absent from the App Store while the legal battle continues in the lower courts.

The outcome of this high-profile case will have far-reaching implications for the app industry and the relationship between app developers and platform operators. The App Store’s dominance and the commission structure imposed by Apple are under scrutiny, as regulators and lawmakers around the world closely monitor the developments.

As the legal battle rages on, both Epic Games and Apple are committed to defending their respective positions. The denial of Epic Games’ request by the Supreme Court is a notable development in this ongoing saga, underscoring the complexity and significance of the issues at stake.
